APEC Public Holiday Act 2007
The APEC Public Holiday Bill 2007 (the Bill) was introduced into the House of Representatives on 8 August 2007. The Bill was passed by Parliament on 17 August 2007 and commences on Royal Assent. The Bill received Royal Assent on 3 September 2007.
The New South Wales Government has appointed Friday, 7 September 2007 as a public holiday for certain local government areas of metropolitan Sydney, to coincide with the Asia-Pacific Economic Cooperation (APEC) Economic Leaders Meeting.
Some federal system employees who work in the local government areas in which the APEC holiday is to be observed may not be entitled to public holiday entitlements on this day under the terms of their industrial instrument. For example, the instrument may only provide for public holiday entitlements for holidays declared across an entire state, but not for regional or local public holidays, such as APEC.
The APEC Public Holiday Act 2007 (the Act) provides that any reference in federal instruments to a public holiday is taken to include the APEC public holiday, but only in the local government areas in which the APEC holiday is to be observed. That is, the Bill deems 7 September 2007 as a public holiday for federal system employees covered by any federal industrial instrument and who work in the local government areas in which the APEC holiday is to be observed.
The Act ensures that all federal system employees working in the designated local government areas will receive the same public holiday entitlements under their industrial instrument on the APEC holiday as they would receive for any other public holiday.
Areas and Boundaries
The APEC public holiday will apply in relation to businesses, schools, workplaces and services within the following Local Council Areas (it does not operate on the basis of a person’s place of residence – if a person’s workplace is outside these areas, that workplace will not be subject to the public holiday even if the person lives within those areas):
