APEC Public Holiday Sydney only - Friday 7 September 2007

Public holiday entitlements apply for all employees who work in designated local council areas of Sydney on Friday 7 September 2007, as a result of the Asia-Pacific Economic Co-operation (APEC) legislation.

Legislation, passed by Federal Parliament, ensures everyone covered by the federal workplace relations system in the specified Sydney areas will receive their workplace entitlements.

This means that if you work in the designated local council areas of Sydney and are bound by a federal industrial instrument, you will receive all public holiday entitlements under your instrument for the APEC public holiday. Also, employees covered by the statutory entitlement under the Workplace Relations Act cannot be penalised by an employer for refusing to work that day on reasonable grounds.

The APEC public holiday applies to workplaces including businesses, schools and services within the following local council areas of Sydney:

Ashfield
Auburn
Bankstown
Baulkham Hills
Blacktown

APEC organisers advise that entitlement to the holiday is not based on a person’s place of residence. If you live within the designated area but work outside the area, you are not entitled to the public holiday. If you work outside these areas, you will not receive the public holiday.

Employers within the designated zone should ensure that relevant time and wage records reflect public holiday entitlements where applicable.
